Duties | Reseach/Writing as assigned and directed by one adminstrative law judge. Research will be primarily case research, but also could be research into statutes/legislative history. Writing may be one or more of the following: "bench memo" (identifying issues for judge prior to hearing); order (such as a procedural order or an order addressing motions to compel or motions for summary decision); drafts of decisions (or parts of decision), for release. There may also be some opportunity to observe hearings or settlement conferences. | |
Agency description | Judges assigned to the Office of Administration Law Judges (OALJ) adjudicate cases grounded in many different federal statutes. These include claims for compensation benefits under the Black Lung Benefits Act and Longshore and Harbor Workers' Compensation Act. Additionally, OALJ cases include "whistleblower" complaints under the Sarbanes-Oxley Act, as well as complaints filed by workers from many different industries - e.g. , airlines. See www.oalj.dol.gov for additional information. In the Cherry Hill office, we have 4 judges, three law clerks (new attorneys), and a support staff. | |

Position requirements | Prefer students who have taken a course in employment law or employment discrimination, but this is not an absolute requirement. No prior legal experience necessary. Strongly prefer students who have good grades in legal writing course (B+ or higher). | |
Substantive prerequisites | Some course work (law school or undergrad) in labor/employment preferred, but not essential. | |

Restrictions | Due to the potential for conflicts, students should not be working at private law firms during this externship - Several local law firms represent clients in cases before the OALJ. | |
