Biography

Mark Makhail counsels individuals and businesses across a wide range of industries in complex commercial and business related disputes including corporate divorces, trademark and copyright infringement, tortious interference, and contract disputes in both state and federal courts. Mark also has a deep knowledge of alternative dispute resolution procedures and regularly represents clients in various ADR forums. Separately, he assists in court-appointed special master, American Arbitration Association (AAA), and the International Centre for Dispute Resolution (ICDR) assignments.

Mark has extensive experience in patent litigation, particularly in the pharmaceutical and Hatch-Waxman (ANDA) context. He regularly practices in federal court and has established himself as an authority on litigation in district courts across the nation, with a particular focus on the District of New Jersey. Mark’s experience and practical knowledge has made him a sought after local counsel for a wide array of matters throughout the country.

In addition to his litigation practice, Mark regularly assists with government affairs related matters and various regulatory issues. He frequently counsels solar and renewable energy clients on regulatory matters and interfaces with state and federal government agencies on their behalf. Mark also actively assists clients in the aviation sector on intellectual property, Federal Aviation Administration (FAA), and business matters, including aircraft and Part 135 Certificate purchases.

Prior to joining McCarter, Mark served as a litigation associate at various New Jersey law firms. He also has extensive experience as a judicial law clerk starting his legal career as a law clerk in the Superior Court of New Jersey for Assignment Judge Thomas L. Weisenbeck and retired Appellate Division Judge Donald S. Coburn. Later Mark served as a law clerk in the United States District Court for the District of New Jersey for Chief District Judge Jose L. Linares. During his clerkship with Judge Linares, Mark assisted the Court in overseeing numerous receivership matters involving the Securities and Exchange Commission, the Commodity Futures Trading Commission, and the Federal Trade Commission, as well as many environmental matters. At the end of his clerkship for Judge Linares, Mark served a special term as law clerk to the Honorable Claire C. Cecchi, assisting in the trial of Immunex v. Sandoz.
